Appellate Win By Nate Lichtenstein and Ben Haskin Featured In Chicago Daily Law Bulletin

Aronberg attorneys Nathan Lichtenstein and Benjamin Haskin's appellate win for a bank client is featured in the May 31, 2016, edition of the Chicago Daily Law Bulletin in an article titled “Company sued bank too late over deposits.”

Nate and Ben represented MB Financial in the case, PSI Resources LLC v. MB Financial Bank, National Association, 2016 IL App (1st) 152204.

The author of the Chicago Daily Law Bulletin article, David Thomas, writes that “Lichtenstein said they are pleased with the decision as it affirms the obligation of the account holder to review the statement and timely notify the bank of any errors.”

PSI Resources sued Cole Taylor in February 2014 for breach of contract, alleging Cole Taylor incorrectly deposited checks from its assignee companies into the wrong accounts for three years. MB Financial Inc. acquired Cole Taylor’s parent company in August 2014 and merged the two banks under the MB Financial banner.

Cook County Associate Judge James E. Snyder granted summary judgment in favor of MB Financial Bank in March 2015 after finding the three-year statute of limitations applied and had passed before the plaintiffs filed their suit. PSI appealed, arguing that the 10-year statute of limitations applied. The appellate court panel, comprised of Justices Robert E. Gordon, Jesse G. Reyes and Bertina E. Lampkin, affirmed Judge Snyder’s decision.
