As the pandemic continues on and restrictions are set in place for unvaccinated individuals, more divorced parents are struggling to reach an agreement about vaccinations, leading to increased mediation and court hearings.

Staci Balbirer recently offered insights on how courts will handle parent disagreements regarding COVID-19 vaccinations for children in the Chicago Sun-Times article “Divorce attorneys brace for exes battling over kids getting COVID-19 vaccine.”

In the article, Staci explained when divorced parents are unable to reach acceptable terms in the mediation process, the matter will go to court where the judge often appoints a guardian ad litem to act in the best interests of the child.

“That person will look at the facts. Is the child immunocompromised, is the child attending in-person school, do they have siblings, are they in extracurricular activities?” Staci said. “The court is going to look at that when determining if the vaccine is the best decision for the child and it’s going to be a hard decision for the courts to make.”
