Chris Bannon Obtains Judgment for Insurer in Coverage Dispute Over Restitution

Insurance Coverage litigator Chris Bannon recently obtained a declaratory judgment in favor of the firm’s client, an errors and omissions insurer, in a declaratory judgment action. The insured, an Illinois municipality, sought coverage for an underlying class action suit in which the plaintiff sought return of an administrative fee the city collected for towing impounded automobiles. Our client disclaimed coverage and sought a declaratory judgment that it had no duty to defend or indemnify the city for the class action The court agreed with our client’s determination, finding that the relief the plaintiff class sought – restitution of moneys to which the city would not be legally entitled – was not covered by the insurance policy.
