Aronberg Goldgehn attorney Alan S. Wernick will co-present “The Biometric Information Privacy Act After Rosenbach: A Survey of the Legal Landscape,” at the Chicago Bar Association’s Labor & Employment Law Committee’s December meeting.

The Biometric Information Privacy Act (“BIPA”) 740 ILCS 14/1 et seq., is a comprehensive BIP statute that has given rise to a number of class-action lawsuits against businesses. In Rosenbach v Six Flags Entertainment Corporation, 2019 IL 123186 (January 25, 2019) the Illinois Supreme Court held “…an individual need not allege some actual injury or adverse effect, beyond violation of his or her rights under the Act [BIPA], in order to qualify as an ‘aggrieved’ person and be entitled to seek liquidated damages and injunctive relief pursuant to the Act.”

Alan and his co-presenter, Alejandro Caffarelli, will discuss the issues and liabilities under BIPA. They will also explain what lawyers should discuss with their clients to help them address or mitigate BIPA liabilities.

The meeting will take place on Dec. 11, 2019, from 12:15 p.m. to 1:30 p.m. at 321 S. Plymouth Court. It will also be broadcast live at www.chicagobar.org.
